Article 2 — Scope

These General Terms and Conditions (the “Terms”) apply to all services ordered from France Cab & Services, whether by an individual or a business client (the “Client”). Any booking implies full acceptance of these Terms. Specific conditions agreed in writing in a quotation or a partnership agreement prevail over these Terms.

Article 3 — Services

France Cab & Services provides chauffeur-driven transport with premium vehicles in Paris, the Île-de-France region and the French Riviera (Nice, Cannes, Antibes, Monaco): airport and railway station transfers, hourly and daily chauffeur services, business travel, VIP and diplomatic transport, services for hotels and concierges, event transport, sightseeing tours and bespoke journeys. Each vehicle is driven by a professional chauffeur holding the required licences.

Article 4 — Booking and confirmation

Bookings are made by e-mail, telephone, WhatsApp or through the online booking form. A booking becomes final once France Cab & Services has sent a written confirmation and, where applicable, the required payment has been received. The Client must provide accurate information: passenger names and number, pick-up and drop-off addresses, date and time, flight or train number, luggage and any special requirements (child seats, assistance).

Article 5 — Vehicles

The vehicle category is stated in the confirmation (Mercedes-Benz E-Class, S-Class or V-Class, BMW 7 Series, Rolls-Royce depending on the assignment). For operational reasons, France Cab & Services may provide a vehicle of equivalent or higher category at no extra cost. France Cab & Services may entrust a service to a licensed partner operator offering the same standard of quality, while remaining responsible towards the Client.

Article 6 — Prices

Prices are set out in the quotation or confirmation, in euros, inclusive of VAT for individual clients and stated both excluding and including VAT for business clients. Depending on the nature of the service and in accordance with applicable tax regulations, VAT is charged at 10% on transfers and defined journeys, and at 20% on hourly and daily chauffeur services.

Transfers with a pick-up time between 10 pm and 6 am are subject to a 20% surcharge, increased to 30% when the pick-up takes place on 24 or 31 December from 8 pm, or before 6 am the following morning.

For hourly and daily services, these surcharges apply pro rata to the billable time performed within each of these time slots.

They are not cumulative: the 30% surcharge replaces the night surcharge.

Sundays and public holidays are charged at the standard rate. Any additional service requested during the journey (extra stop, detour, extended duration) is invoiced in addition, as stated in the confirmation.

Article 7 — Waiting time

Complimentary waiting time is included: 60 minutes at airports from the actual landing time, 30 minutes at railway stations from the scheduled arrival time, and 15 minutes at any other pick-up location from the booked time. Beyond this period, waiting time is charged per 15-minute period started, at the rate stated in the confirmation. Flights are monitored in real time; the Client is responsible for informing France Cab & Services of any change.

Article 8 — Payment

Individual clients pay the full amount at the time of booking. Such amounts constitute payment of the price and not a forfeitable deposit (arrhes) within the meaning of Article L.214-1 of the French Consumer Code; their treatment in the event of cancellation is governed by Article 9. Unless otherwise agreed in writing, business clients pay within 30 days of the invoice date. For events, a 50% deposit is due at booking and the balance no later than 7 days before the event. Late payments by business clients incur penalties at the European Central Bank refinancing rate plus 10 percentage points and a fixed recovery fee of €40, in accordance with Article L.441-10 of the French Commercial Code.

Article 9 — Cancellation and changes

9.1 Cancellation by the Client. Any cancellation must be made in writing (e-mail to booking@france-cab.com or the cancellation link in the confirmation); the time of receipt is authoritative. Transfers may be cancelled free of charge up to 24 hours before the scheduled pick-up time; thereafter, 100% of the price is due. Hourly and daily services may be cancelled free of charge up to 48 hours before the scheduled start; thereafter, 100% of the price is due. Events: cancellation more than 15 days before the event, free of charge; between 15 and 8 days, 50% of the price; 7 days or less, 100% of the price.

9.2 Cancelled flight or train. If the Client’s flight or train is cancelled by the carrier, the related transfer may be cancelled free of charge up to the pick-up time, upon proof. Delays are monitored in real time and incur no charge, as set out in Article 7.

9.3 No-show. A Client who does not appear at the pick-up location by the end of the complimentary waiting time, without having informed France Cab & Services, is considered a no-show; the full price is due.

9.4 Changes. Changes requested before the free cancellation deadline are free of charge, subject to availability; the price is adjusted if the service changes. After that deadline, a change is treated as a cancellation followed by a new booking, unless France Cab & Services agrees otherwise.

9.5 Cancellation by France Cab & Services. If France Cab & Services cancels a service for any reason other than force majeure or an act of the Client, and cannot offer a replacement vehicle accepted by the Client, it refunds all amounts paid and pays the Client compensation equal to the cancellation fee the Client would have borne had they cancelled at the same time.

9.6 Refunds. Any refund due is made within 14 days of the cancellation at the latest, using the payment method used for the booking, at no cost to the Client.

Article 10 — Client obligations

Passengers must wear seat belts, refrain from smoking and vaping in the vehicle, and respect the chauffeur and the vehicle. The number of passengers and pieces of luggage must not exceed the capacity stated in the confirmation. Cleaning or repair costs resulting from damage caused by a passenger are charged to the Client at actual cost. The chauffeur may refuse or interrupt a service if the safety of persons is at risk.

Article 11 — Liability and insurance

France Cab & Services holds motor and paying-passenger liability insurance with Mutuelle Fraternelle d’Assurances (MFA, 6 bis rue Fournier, 92110 Clichy, member no. 726470) and professional liability insurance with Generali IARD (policy no. AT282820). France Cab & Services undertakes to use all reasonable means to ensure punctuality, but cannot be held liable for delays caused by traffic conditions, roadworks, weather, police checks, the Client or any event of force majeure. Personal belongings remain under the passengers’ responsibility; items found in vehicles are kept for 30 days.

Article 12 — Force majeure

Neither party shall be liable for failure to perform its obligations due to an event of force majeure within the meaning of Article 1218 of the French Civil Code. Amounts already paid for services that cannot be performed for this reason are refunded or carried over, at the Client’s choice.

Article 13 — Personal data

Personal data collected are used solely to manage bookings, invoicing and customer relations, in accordance with the General Data Protection Regulation (GDPR). The Client may exercise their rights of access, rectification, erasure and objection by writing to contact@france-cab.com.

Article 14 — Complaints and mediation

Any complaint must be sent in writing to contact@france-cab.com within 15 days of the service. Individual clients may refer the matter free of charge to the consumer mediator CM2C (Centre de la Médiation de la Consommation de Conciliateurs de Justice), 49 rue de Ponthieu, 75008 Paris, France, tel. +33 1 89 47 00 14, litiges@cm2c.net, with online referral at https://www.cm2c.net/declarer-un-litige.php, after first contacting France Cab & Services in writing. In accordance with Article L.221-2, 9° of the French Consumer Code, passenger transport contracts are not subject to the statutory right of withdrawal applicable to distance contracts; the cancellation terms of Article 9 apply.

Article 15 — Governing law and jurisdiction

These Terms are governed by French law. The French version prevails over any translation. Disputes with business clients fall under the exclusive jurisdiction of the Commercial Court of Paris. Individual clients may bring proceedings before the court with jurisdiction under applicable consumer law.
